Advertising Terms, Conditions and Legal Disclaimer
6. Independent Advertisers and Third-Party Responsibility
Linkeora may provide advertising space or promotional services to independent businesses, employers, recruitment agencies, advertisers, sellers, and other third parties.
Unless expressly stated otherwise in a written agreement, Linkeora acts as the provider of the relevant advertising space or platform service and does not become the owner, operator, employer, agent, business partner, financial guarantor, or contractual supplier of an advertiser’s underlying products, services, recruitment activities, or business transactions merely by publishing an advertisement.
Each advertiser is an independent party and remains responsible for its own business, representations, products, services, employment opportunities, offers, contracts, financial dealings, and legal obligations.
The publication of an advertisement does not automatically mean that Linkeora endorses, certifies, guarantees, or recommends the advertiser.
7. Third-Party Fraud, Scams and Financial Losses
Important notice for all advertisers, customers, candidates, and other users.
Linkeora takes the integrity of its platform seriously. However, independent advertisers and third parties may act outside Linkeora’s control.
To the maximum extent permitted by applicable law, Linkeora shall not be liable for financial losses, fraudulent transactions, misrepresentations, unpaid refunds, failed business deals, false employment offers, or other losses caused by an independent advertiser or third party, except to the extent that such liability arises from Linkeora’s own conduct or is otherwise imposed by law.
This includes, where legally permissible, losses arising from:
- A company, recruiter, employer, seller, or service provider collecting money and subsequently engaging in fraud.
- An advertiser accepting a deposit, advance payment, registration fee, processing fee, service charge, or other payment and failing to provide the promised product or service.
- A recruitment company collecting money in connection with a job offer, employment contract, visa, work permit, training programme, or recruitment service and failing to fulfil its obligations.
- A third party providing false company information, fake documents, misleading promises, or fraudulent payment instructions.
- A business refusing or failing to provide a refund that it legally owes.
- A transaction entered into directly between an advertiser and a customer, candidate, employer, or other third party.
- A third party’s insolvency, disappearance, breach of contract, unauthorised conduct, or failure to fulfil its commitments.
Where a user pays an independent advertiser directly, the resulting transaction is ordinarily between that user and the advertiser. Linkeora does not automatically become responsible for the payment, the advertiser’s performance, or the recovery of funds.
Users should independently verify the identity, legitimacy, licensing where required, contractual terms, and payment details of an advertiser before transferring money or entering into a transaction.
Users should not assume that a business is trustworthy solely because it has purchased advertising space, appears on Linkeora, or displays a verification badge.
A verification badge, if available, represents only the checks specifically described in Linkeora’s verification policy and is not a guarantee against fraud.
This section does not exclude or limit Linkeora’s own liability for fraud, wilful misconduct, actionable negligence, breach of its contractual obligations, or any other liability that cannot lawfully be excluded or limited.
8. Advertising Fees and Payments
Advertising fees, package prices, campaign durations, payment schedules, applicable taxes, and any additional charges will be communicated through Linkeora’s official channels or the relevant written agreement.
Advertisers must review the quotation, scope of services, cancellation conditions, and other applicable terms before making payment.
Payments requested by Linkeora must be made only through the official payment methods identified in the relevant invoice or written payment instructions.
Linkeora shall not be responsible for payments sent to an individual, unofficial account, impersonator, fraudulent payment link, or other unauthorised recipient merely because that recipient claims to represent Linkeora.
If you receive an unexpected payment request, verify it using Linkeora’s official contact details before transferring money.
Where a third-party advertiser collects money directly from a customer, candidate, or another business, that payment is not automatically a payment to Linkeora.
Where Linkeora itself receives payment for an advertising service, its obligations concerning that service will be determined by the applicable agreement and mandatory law.
9. No Guarantee of Advertising Results
Linkeora may offer different advertising packages, placements, campaign durations, and promotional formats.
Unless expressly agreed in writing, Linkeora does not guarantee:
- A specific number of impressions, clicks, views, leads, or enquiries.
- A particular search ranking or permanent advertising position.
- Job applications, interviews, successful recruitment, sales, or business growth.
- A specific conversion rate, return on investment, or level of revenue.
- The availability of every advertising placement at all times.
- That an advertiser’s target audience will respond to an advertisement.
Any estimates or historical performance figures supplied by Linkeora are informational unless expressly incorporated into a written agreement as binding commitments.
10. Advertiser Representations and Legal Compliance
Each advertiser is responsible for ensuring that its advertisements and underlying business activities comply with all laws applicable to that advertiser, advertisement, product, service, and target market.
Advertisers must not publish false, misleading, deceptive, discriminatory, defamatory, infringing, fraudulent, or unlawful advertisements.
Advertisers are responsible for:
- The accuracy of all claims, descriptions, prices, offers, qualifications, and promotional statements.
- Obtaining necessary licences, permissions, consents, approvals, and authorisations.
- Ensuring that advertised products and services may lawfully be promoted and supplied.
- Complying with applicable consumer-protection, employment, recruitment, advertising, intellectual-property, privacy, electronic-commerce, tax, and other relevant laws.
- Disclosing material conditions, restrictions, fees, and limitations where required.
- Obtaining the necessary rights to use photographs, logos, trademarks, music, videos, and other creative materials.
- Ensuring that advertisements do not promote prohibited products, illegal services, scams, or unlawful financial activities.
- Responding to customer complaints and fulfilling their own contractual and statutory obligations.
Linkeora may request supporting evidence or additional information before approving an advertisement.
11. Prohibited Advertising
Linkeora may reject, suspend, or remove advertising that it reasonably considers to involve:
- Fake jobs, fraudulent recruitment, or misleading visa and immigration promises.
- Unauthorised collection of recruitment fees or other prohibited charges.
- Counterfeit products, intellectual-property infringement, or impersonation.
- False claims, deceptive discounts, or misleading promotional offers.
- Unlawful financial schemes, money laundering, or fraudulent investment opportunities.
- Illegal, restricted, or prohibited products and services.
- Discrimination or unlawful exclusion in employment or commercial opportunities.
- Privacy violations, unauthorised disclosure of personal information, or misuse of CVs and candidate data.
- Content that violates applicable law or Linkeora’s published policies.
Linkeora may take reasonable action to investigate complaints, restrict advertisements, suspend accounts, preserve relevant records, and cooperate with competent authorities where appropriate or legally required.
12. Review, Approval and Removal
All advertising is subject to the applicable submission requirements and review procedures.
Linkeora may decline, edit for technical formatting, suspend, or remove an advertisement where reasonably necessary for compliance, security, quality control, or enforcement of its policies.
Linkeora does not guarantee that every advertisement will be detected as fraudulent or unlawful before publication.
Where legally required, Linkeora will comply with applicable notice, complaint-handling, consumer-protection, and other procedural obligations.
An advertiser remains responsible for the legality and accuracy of its advertisement even after approval.
13. Cancellation, Refunds and Campaign Changes
The cancellation, rescheduling, modification, and refund conditions applicable to an advertising campaign will be specified in the relevant quotation, package description, or written agreement.
Refund eligibility may depend on whether the campaign has started, whether services have been delivered, the reason for cancellation, and the applicable law.
Linkeora does not guarantee a refund for every cancellation or change of mind.
However, nothing in these Terms removes any refund, cancellation, chargeback, or other statutory right that cannot lawfully be excluded.
If an advertiser pays a third party directly for services unrelated to a payment collected by Linkeora, any refund claim relating to that transaction should ordinarily be directed to the relevant third party, subject to applicable law.
14. Intellectual Property and Advertising Materials
Advertisers must own or have the necessary permission to use all materials submitted for publication.
By submitting advertising materials, an advertiser grants Linkeora a non-exclusive licence to host, reproduce, format, display, distribute, and use those materials as reasonably necessary to deliver, manage, and promote the agreed advertising campaign.
The advertiser remains responsible for obtaining permissions and handling claims arising from materials it supplies.
Linkeora retains ownership of its own branding, logos, platform design, software, and other proprietary materials.
No advertiser may imply official endorsement by Linkeora without written authorisation.
15. Confidentiality and Personal Information
Advertisers must handle personal information obtained through Linkeora lawfully and only for authorised purposes.
Advertisers must not misuse candidate CVs, contact information, customer details, or other personal data for unauthorised marketing, fraud, identity theft, or unrelated purposes.
The processing of personal information by Linkeora is governed by its Privacy Policy and applicable data-protection laws.
Advertisers remain responsible for their own data-handling practices and legal obligations.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Linkeora shall not be liable for indirect, incidental, special, punitive, or consequential losses arising from an independent advertiser’s conduct, a third-party transaction, or the performance of an advertised product or service.
Subject to applicable law, Linkeora shall not be liable for losses resulting from an independent advertiser’s fraud, failure to deliver, breach of contract, refusal to refund, false statements, or unauthorised collection of money, except to the extent that Linkeora is legally responsible for its own conduct or omissions.
Where a claim arises directly from an advertising service supplied by Linkeora, liability will be determined by the applicable agreement and law.
No provision of these Terms excludes liability for matters that cannot lawfully be excluded, including any non-excludable consumer rights or mandatory statutory obligations.
17. Indemnification by Advertisers
To the extent permitted by applicable law, advertisers agree to indemnify Linkeora against third-party claims, losses, damages, liabilities, and reasonable legal expenses arising directly from:
- The advertiser’s unlawful, fraudulent, or misleading conduct.
- Materially false information or unauthorised claims in advertising materials.
- The advertiser’s breach of these Terms or a relevant advertising agreement.
- Infringement of third-party intellectual-property or privacy rights by advertiser-supplied materials.
- The advertiser’s failure to comply with applicable licensing, recruitment, consumer-protection, or advertising requirements.
This provision does not require an advertiser to indemnify Linkeora for losses caused by Linkeora’s own wrongdoing where such recovery is prohibited by law.
18. Complaints and Fraud Reporting
If you suspect that an advertiser is fraudulent, has impersonated Linkeora, has issued false payment instructions, or has engaged in misleading conduct, please report the matter promptly.
Official Contact Email: [Insert Support Email]
Advertising Enquiries: [Insert Advertising Email]
Please include the relevant advertisement URL, company name, communication records, invoices, payment evidence, and other supporting information where available.
Linkeora may investigate the report, restrict the relevant advertisement, request additional documentation, or refer the matter to appropriate authorities where necessary.
If you have already transferred money and suspect fraud, contact your bank or payment provider promptly and report suspected criminal activity to the appropriate authorities.
Linkeora cannot guarantee recovery of money transferred to an independent third party.
19. Suspension and Termination of Advertising
Linkeora may suspend or terminate an advertising campaign or advertiser account if it reasonably believes that the advertiser has breached these Terms, supplied fraudulent information, misused the platform, or created a legal, financial, or security risk.
Any outstanding payments, refunds, and other obligations will be handled under the applicable advertising agreement and law.
Termination does not remove rights or liabilities that arose before termination.
20. Governing Law and Dispute Resolution
These Terms are subject to the laws of [Insert Applicable Jurisdiction], together with any mandatory laws that apply to the relevant advertiser, transaction, or service.
The parties should first attempt to resolve disputes through the official Linkeora contact channels where appropriate.
Any unresolved dispute may be referred to a court or dispute-resolution body with lawful jurisdiction.
Nothing in this section prevents a party from exercising a mandatory legal right or bringing a claim before a competent authority where applicable law permits or requires it.
21. Changes to These Terms
Linkeora may update these Terms to reflect changes in advertising services, platform operations, security requirements, or applicable law.
The updated version will be published on the website with a revised effective or last-updated date.
Where required by law, appropriate notice or consent will be obtained.
